Tattoo Establishments

Big Stone, Chippewa, Lac Qui Parle, Swift and Yellow Medicine Counties have adopted an ordinance regulating the design, construction and operation of tattoo establishments. The purpose of this ordinance is to prevent the transmission of communicable disease and to promote the general welfare of the public. In addition to these county requirements, there may also be requirements from the city or township where the tattoo establishment is located.

All of the information submitted with your license application must be accurate and complete. Submission of false information is a violation of the tattoo ordinance and subject to penalties. In order to obtain a license for the operation of a tattoo establishment the following information is needed:
  1. Submit a completed license application form together with the appropriate fees.
  2. Submit a completed scaled drawing of the tattoo establishment identifying all aspects of the establishment (i.e., equipment, storage, toilet rooms, handwashing lavatories, etc.)
  3. Submit a copy of your permission form for minors and describe how the age of the minor is verified and how the identity of the minor and parent is verified.
  4. Information must be provided on how you will find out if the client has a communicable disease that could be transmitted in the tattooing process and/or if the client has had viral hepatitis B or other bloodborne diseases.
  5. Submit a copy of your infectious waste management plan and a copy of the acknowledgement card from the Minnesota Department of Health.
  6. Submit evidence that the building complies with the provisions of the Minnesota State Building Code.
  7. Submit information detailing your procedures for the following:
    • Preparation and set up for tattooing (i.e., clean up procedures and equipment/materials to be used in the tattooing including infection control measures).
    • Preparation of the tattoo artist including infection control procedures.
    • Preparation of the skin for tattooing, including equipment, materials, procedures and infection control measures.
    • Describe the tattoo process listing all procedures, equipment, and materials used, which items are clean and which items are sterile, and infection control measures.
    • Describe how needle bars are prepared and handled.
    • Describe how inks/pigments are prepared and handled.
    • Your directions and recommended procedures for protection of the tattoo from infection and/or allergic reactions.
    • Describe what is done with all waste materials during and after the tattooing processes.
    • Information describing cleanup procedures and materials used after the tattooing process (i.e., chairs, tables, needles, needle bars, ink caps, etc.)
    • Describe your sterilizing process (dry heat and/or autoclaving). Which items are subjected to dry heat and which items are subjected to autoclave sterilization? How is the effectiveness of the sterilization process verified?
    • Description of waste management procedures and facilities.
    • Information describing any other activities and/or procedures, not covered above, relating to the operation of this establishment.
  8. Are there any other businesses or activities taking place at this location, and if so describe.
